Who is responsible for processing your personal data?
GRUAS AGUILAR SLU, hereinafter referred to as the CONTROLLER, informs the USER that it has created official profiles on the social media platforms Facebook, Instagram, Twitter, LinkedIn, YouTube, Vimeo and Google+, and that it is responsible for the processing of the USER’s personal data carried out through those social media platforms. The CONTROLLER further informs the USER that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD), and therefore provides the following information regarding such processing.
Why do we process your personal data?
Purpose of the processing: to maintain a relationship between the USER and the CONTROLLER, which may include the following activities:
Processing requests and enquiries submitted to the CONTROLLER.
Providing information about activities and events organised by the CONTROLLER.
Providing information about products or services offered by the CONTROLLER.
Interacting through the CONTROLLER’s official social media profiles.
What is the legal basis for processing your personal data?
Legal basis for the processing: Article 6(1)(a) of the GDPR, whereby the data subject has given consent to the processing of their personal data for one or more specific purposes. The USER has a profile on the same social media platform and has chosen to follow the CONTROLLER’s social media profile, thereby expressing an interest in the information published there. By requesting to follow our official profiles, the USER gives consent to the processing of the personal data made available through their profile.
The USER may access the privacy policies of the relevant social media platform at any time and configure their profile settings to ensure their privacy.
The CONTROLLER has access to and processes the USER’s publicly available information, in particular their contact name. This data is used solely within the relevant social media platform and will only be incorporated into the CONTROLLER’s records where necessary to process the USER’s request.
How long will we retain your personal data?
Data retention criteria: your personal data will be retained until the USER withdraws the consent granted, as indicated in this Privacy Policy.
Who do we share your personal data with?
Disclosure of personal data: the information provided by the USER through the CONTROLLER’s social media profiles, including personal data, may be published, depending on the services used by the USER, and may therefore become publicly available to other users of the relevant social media platform. From the settings of each social media platform, the USER may configure which information they wish to make public, review the permissions granted, and remove or disable them, including any third-party applications they no longer wish to use.
No disclosure of personal data to third parties outside the relevant social media platform is envisaged unless it is strictly necessary for the development and performance of the processing purposes. In such cases, data may be shared with our communications-related service providers, with whom the CONTROLLER has entered into the confidentiality and data processing agreements required under the applicable data protection legislation.
What are your rights?
The USER has the following rights: these rights may only be exercised in relation to the information under the CONTROLLER’s control.
The right to withdraw consent at any time.
The right of access, rectification, data portability and erasure of personal data, as well as the right to restrict or object to its processing. The right to lodge a complaint with the supervisory authority (www.aepd.es) if the USER considers that the processing does not comply with the applicable legislation.

The CONTROLLER will carry out the following actions:
Access the public information available on the USER’s profile.
Publish on the USER’s profile any information already published on the CONTROLLER’s social media profile.
Send personal and individual messages through the social media platform’s communication channels.
Publish updates to the page status that will appear on the USER’s profile.
The USER may at any time manage their connections, remove content that is no longer of interest, and restrict with whom they share their connections by accessing their privacy settings.
Once the USER becomes a follower of, or joins, the CONTROLLER’s social media profile, they may publish comments, links, images, photographs or any other type of multimedia content supported by the relevant platform. In all cases, the USER must be the owner of the content published, hold the corresponding copyright and intellectual property rights, or have obtained the consent of any affected third parties.
Any publication on the social media platform, including but not limited to text, graphics, photographs, videos or any other content that is unlawful or may be considered contrary to morality, ethics, good taste or public decency, and/or that infringes intellectual or industrial property rights, image rights or applicable law, is expressly prohibited.
In such cases, the CONTROLLER reserves the right to remove the content immediately, without prior notice, and may request the permanent blocking of the USER.
The CONTROLLER shall not be held responsible for any content freely published by a USER.
The USER acknowledges that any content they publish may be viewed by other users and therefore remains primarily responsible for protecting their own privacy.
Any images published on the social media platform will not be stored by the CONTROLLER in its own records but will remain available on the relevant social media platform.
Access to and registration with the CONTROLLER’s social media profiles is prohibited for persons under 18 years of age. Where the USER has special legal capacity requirements, the intervention of the person holding parental authority or legal guardianship, or of the USER’s legal representative, shall be required, supported by a valid document proving such representation.
The CONTROLLER shall be expressly exempt from any liability arising from the use of its social media profiles by minors or persons with special legal capacity requirements. The CONTROLLER’s social media profiles do not knowingly collect personal information from minors. Therefore, if the USER is under 18 years of age, they must not register with or use the CONTROLLER’s social media profiles, nor provide any personal information through them.
